When do I need to file my CA amendment?
If you need to make any adjustments to your California state return or if the changes in your federal return affected your state return, you may need to file an amended return. You have 4 years from the original due date to file an amended California income tax return when requesting a refund, or within a year of over-payment of income tax, whichever date is later.

What should I expect when I file an amended return?
The state of California may impose the following penalties and interest fees:

  • When taxes due are unpaid by the tax return deadline, you may be charged an underpayment penalty of 5% plus 0.5% per month (or part of month) the taxes due remains unpaid, not to exceed 40 months. There is a maximum penalty of 25% of the total unpaid taxes.
  • If a return is filed after California’s due date, a 5% delinquent penalty is charged on unpaid taxes. The 5% delinquency penalty will be incurred each month the return remains unfiled up to a maximum of 25% of the unpaid taxes due. The minimum penalty for late returns is $135 or 100% of the unpaid taxes due (whichever is less).
  • Any late or delinquent payment will be charged an additional interest fee (currently 3%) from the original tax return deadline. If other penalties are not paid within 15 days of the date of a billing notice, interest will be charged from the date of the notice until the payment date.
